Absolutely zero chance they could make that charge stick, unless she has an idiot for a lawyer.

The negative publicity from this will be fairly high, I also wonder how many people will return cars to enterprise using their drop off at Portland street?

Aren't a lot of these operations franchised? I wonder if its the franchisee that is trying to do this...but either way its up to head office to ensure this stuff does not happen.

And that's what baffles me about this.  Zero chance in getting a dime from this lady for obvious reasons followed by a landslide of negative publicity.  What kind of moron in charge actually thinks this is a good move for them?   ::)

It won't be a corporate store rather a franchise.  Be aware of the difference  You gotta be nuts to drop off a rental without a sign off.

The outcome is in the fine print of the contract.

Because she had returned the car according to their own policy, and they have zero proof she stole it.

Of course, they can claim it's still her fault, but the courts would prove they have no cause against her.

I'd wondered about that. What's to say a car couldn't get dinged in the lot between you dropping it off and the store opening in the morning? Who's liable then?  I have to think the contract is heavily slanted in the rental compamie's favour.

The only thing that may save this woman is the publicity. Franchise store or not I would expect Enterprise's head office will step in to try and make this story go away. If they don't they're pretty stupid. This can negate many more dollars worth of advertising than the value of a Mustang.

If the car is damaged after you drop it off, but before it's inspected, ie after hours, you are responsible unless you can prove otherwise.

I wonder why enterprise doesn't have security cameras?  Especially considering their location, I'd say they were negligent.

You are allowed to, but you're taking a risk.

Of course, they encourage that.

It all about the contract you sign which in this case is still an unknown.  I would not want to be her.  Her Visa deposit is history.    However, if you think civil contracts can be voided by "what should be", you're hugely mistaken.

Along with the "I didn't know"; "who would have thought"; and "wasn't thinking at the time"; which is my personal favourite.  ;D

All of which have often been accepted by the often anti-business quasi-judges sitting in small claims court.
