If this was Joe Shmoe and his Corolla, it wouldn't even be an issue - the most he could expect is to have the damage repaired. If this guy gets his so-called residual losses covered, why shoudn't everyone else?  ::)

I believe everybody should get their "residual losses" covered, but of course our insurance rates would at lease double.

Quebec has a different civil code than the rest of Canada so if the Lambo guy wins I dunno what effect that would have on owners outside of Quebec.  Regardless, it would be interesting to follow this incident.

The dealer should buy the vehicle for fair market (pre accident).

Exactly, and if the dealer thinks the value has not been affected by the incident, he has nothing to worry about. He'll get his money back.

That's gotta hurt!  If it was just an oil change or routine service, I'm curious why the tech took the car out for a spin in the first place???

IMO residual losses should be covered as well, at least in the case of a business operation crashing someone's car.

What happened here is pretty clear. Someone decided to go for a joyride and crashed it, and now the owner is taking the loss (pending possible court proceedings or dealer "goodwill"). Its one of those (many) things in life where the offender does not bear the full risk of his actions.

Risk adjusted basis the oil change should probably be free. Figure $50k residual loss and a 0.5% chance every time that someone crashes it on a joyride. Very simplistically, that's $250 at risk every oil change. How much is the oil change?
