Thanks guys, last few days been really bad for me but thanks for all your advise.

I got the cheque yesterday and it says"Actual value is determined by the market value, age and codition of your vehicle as the date of the lost. To assist us in determining actual cash value we consider information obtained by our representatives" the letter also says "if now or later you have additinal information you wish us to consider or if you belive we have not correctly determined the actual cash value please contact the adjuster" Do you think I can still ask them. I called the dealership they gave me adifferent MSRP price?

My car had 5500KM's and it was really well taken care of. I even took it for oil chage to the dealership. I sign for the cheque because why pay intrest on the loan And I also have to put $400 cash to payoff the loan last night.

That doesn't sound like they applied the Waiver of Depreciation to your claim.  In your case "actual cash value" is essentially pre-determined for 2 years from date of purchase.

I called the dealership they gave me adifferent MSRP price?

You were to determine that days ago and then send a copy of the current price with all extras, written on paper from the dealer, to your insurance company as proof of the "actual cash value".   :bang:

Frankly I think you are beyond the point of further assistance.

I called them now and they are reopening the claim again. I told them to call my dealer to get the information. Let see what they come up with now.

My advice is take the money now before the 2009 Mazda3s come because their MSRPs are going to be $2000 less than the 2008.5s
If the insurance company finds out about this and you hold out for too long, you will receive $2000 less.

My loss of my 2002 Jetta 1.8T was at the best possible time, right before the MFGs started to reduce MSRPs on the new cars and before the used car market prices started to fall.
Emotionally sad, but finacially lucky!  :-\
