This seems to be getting more and more common, Where laws in the US and Canada are being created without the mechanisims in place to protect the rights of the common citizen. Have our law-makers lost it or something? I don't get why things are becoming more draconian on a daily basis.

That's it in a nutshell.  You can't have a law that carries a penalty of six months in jail, with no option to mount a defence.  That's stupid.  This is still Canada.

I didn't realize that Shaw Cable was available in Topeka (Google), Kansas.  Interesting.

Well.
The lawmakers are not chosen for their intelligence OR their skill at reading the Us or Cdn Constitution... although most of them are lawyers in both countries.
The legislators probably assume that:
   Very few people have the money to fight a constitutional case of any sort
   Most people will just pay the fine and complain about it, no more.
   In Canada, class actions against the government may ( not sure on this) not be possible in practice
   and the Canadian constitution has a let out for legislators and Judges.
   In the US, one gets the impression that Homeland security with the Patriot act have doen a great job of
   scaring the public into seeing terrorists hiding behind every tree and therefore not to question laws any more

and so they can pass any unconstitutional law and get away with it for years at least.

In the particular case the Judge is a Provincial judge and his rulings are not binding until re-inforced by a superior court.


The most radical revolutionary will become a conservative the day after the revolution.

I don't agree with any of the terms the provincial government has come up with.

If I am doing X km over the "posted limit", then ticket me so and not with racing or stunting.

I really don't have an issue since I drive quite sensibly and if I wanted to let it all hang out, then I'd go to the track at Mosport or Calabogie and find out how slow I really am.

A coworker made this statement that these drivers of 10+ convictions of drunk driving better not ever run into any of his kids on the road. The funny thing is, how would he deal with a street racer running into one of his kids when he himself is a loose cannon on the road always bragging about how he just beat another car....to the next light. :rofl:

If the federal, provincial, regional or city governments are in dire need of money, then I'd suggest they get more efficient with what they collect in taxes.  ;)

What you won't find in my car is a coffee, cigarette and a cell phone. What you will find is a driver; imagine that, a driver in a vehicle. What an effing concept!

So what's the status of this story? Is the decision from last year being appealed by the Ontario government? Is it still being enforced?

Yes and Yes.     Until the Court of Appeal gives a verdict it will still be enforced
